授業の目的、または到達目標 To learn international human rights law and its international and regional implementation mechanisms, and to examine the human rights situations in Japan and other parts of the world so as to correctly understand the importance of mainstreaming human rights in all areas of activities related to development, peace, conflict and human security.
本科目の目標は、受講生が国際法および多くの国内法の一部を形成する国際人権法の体系とその実施確保のための国際的制度の全体像を把握すると共に、世界と日本の人権状況の概要を学ぶことである。また、その事を通じて、多民族・多文化共生を含む広義の平和、紛争の防止と解決、人間の安全保障などと人権の尊重・保障との密接な関連性と人権規範を部門横断的に適用する重要性について正しく理解することである。
授業の概要 The development of basic concepts, principles and provisions of major international treaties and other instruments, difference and relationship of domestic legislation and international law, the effect, problems and challenges faced by the international and regional implementation mechanisms.
初めに、人権思想の発展とそれが国際社会の法となるに至った歴史的経緯と背景を概観し、国内法と国際法の違いと関係を大枠で理解する。その上で、主要な人権条約の理念と規定および地域的機構を含めた国際人権保障システムによる履行確保措置とその効果を検討し、問題点や課題を考察する。
