授業の目的、または到達目標 You will be able to develop your own research topic and pursue it. You will be able to explain what is international human rights law; and what mechanisms are available at international, regional and national levels for its implementation. You will be able to identify and analyze what human rights issues are at stake in all areas of activities related to international peace and security, human security, conflict resolution, law and order, and development in a contemporary international society.
あなたが自分の研究テーマを設定し、追求できるようになること。あなたが国際法および多くの国内法の一部を形成する国際人権法の体系とその実施確保のための国際、地域、国内の三レベルにおける制度の概要を他人に説明できるようになること。あなたが国際共生社会における平和と安全、人間の安全保障、紛争解決、法と秩序、開発など様々な分野において発生する人権問題を認識し、分析できるようになること。
授業の概要 The course goes through three stages. The first stage deals with the history of the development of human rights in certain countries, and that of the international development of human rights. The second stage deals with the relationship between international law and municipal (national) law. The third stage deals with the purposes and functioning of, and problems and challenges which are being faced by, implementation mechanisms of human rights at international, regional and national levels.
初めに、人権の発展とそれが国際社会の法となるに至った歴史的経緯と背景を概観し、国内法と国際法の違いと関係を大枠で理解する。その上で、主要な人権条約の理念と規定および地域的機構を含めた国際人権保障システムによる履行確保措置とその効果を検討し、問題点や課題を考察する。
